What Is Trademark Watch?
Trademark watch is the regular screening of new applications published in the Official Trademark Bulletin against your own mark. The purpose is to catch an encroaching application before the two-month opposition window closes. TÜRKPATENT is not obliged to refuse applications similar to earlier marks of its own motion, and it does not notify owners; monitoring is entirely the right holder’s responsibility.
What Happens Without Watching
If a similar application goes unnoticed and the publication period expires, it proceeds to registration. From that point the administrative route closes and only an invalidity action before the courts remains. That route:
- Takes considerably longer
- Costs more, with litigation and expert fees
- Leaves the similar mark in use in the market meanwhile
