What Is a Patent?

A patent is an industrial property right granting its owner, for a limited period, the ability to prevent others from using an invention that brings a new solution to a technical problem. In Türkiye a patent lasts twenty years from the filing date and cannot be extended. To be granted, the invention must be new, involve an inventive step and be capable of industrial application.

Conditions for Patentability

  • Novelty: the invention must not have been disclosed anywhere in the world before the filing date
  • Inventive step: it must not be obvious to a person skilled in the art from existing knowledge
  • Industrial applicability: it must be capable of being made or used

Discoveries, scientific theories, mathematical methods, aesthetic creations and computer programs as such are not regarded as inventions and cannot be patented.

The Application Process

  1. Preliminary search. Technical databases are searched to see whether the invention has already been disclosed.
  2. Drafting. The description, claims, abstract and drawings are prepared. The scope of the claims defines the limit of protection, making this the most critical step.
  3. Filing and formal examination. The file is submitted to TÜRKPATENT and examined for formalities.
  4. Search report. The invention’s position against the state of the art is reported.
  5. Publication. The application is published eighteen months after the filing or priority date.
  6. Examination and grant. On request, substantive examination is carried out and, if the conditions are met, the patent is granted.
