What Is Design Registration?
Design registration is the industrial property right protecting the appearance of the whole or part of a product. It covers visual features such as lines, shape, colour, texture, material and ornamentation — not technical function. In Türkiye a registered design is protected for five years from the filing date and can be renewed in five-year terms up to a total of twenty-five years.
Conditions for Registration
- Novelty: an identical design must not have been disclosed anywhere in the world before the filing date
- Individual character: the overall impression on an informed user must differ significantly from earlier designs
Features of appearance dictated solely by the technical function of the product, and shapes that must necessarily be reproduced to allow mechanical connection to another product, fall outside design protection.
Why the Images Matter
In design registration it is the images filed with the application that define the scope of protection. A feature not shown is not protected. Prepare front, rear, side, top, bottom and perspective views on a plain background, free of shadows and clearly rendered. Surrounding elements you do not wish to claim should be left out.
